On Friday, Oct. 23, the Treasury Department published its proposed rule for the law that bans large institutional investors from buying single-family homes. Congress wrote the ban into the 21st Century ROAD to Housing Act, signed July 11. It bites on Jan. 7, 2027.

The law says no. Treasury's draft decides who still hears yes. Investors who build to rent, fix to rent or run a rent-to-own program can keep buying if they pass Treasury's tests, and you have until Nov. 23 to say whether those tests are tough enough.

Three Doors

Treasury wrote the rulebook for the Wall Street landlord ban, and its first draft keeps three doors open for big investors to keep buying the houses your family would bid on.

Door one is build-to-rent. Under proposed section 36.5 of the Oct. 23 proposed rule, an investor may buy a home nobody ever owned and lived in, within 18 months of its certificate of occupancy, as long as renters move in first.

Poster illustration for the issue: Wall Street Can't Buy Your Block. Unless It Uses These 3 Doors.

Door two is fix-and-rent. The investor has to put in improvements worth at least 15 percent of the purchase price, or 10 percent on the structure and core systems plus every material defect. Treasury would measure that price as the sale price minus the tax-assessed value of the land. By BTP's arithmetic, a smaller base means a smaller check to clear the bar, and Treasury's draft never says so out loud.

Door three is rent-to-own. An investor qualifies by putting up at least the lesser of $5,000 or 2.5 percent of the price for a renter who stays five years, 3.5 percent at seven, measured against the price or the FHA county loan limit, whichever is lower. The renter gets a right of first refusal, a 30-day first look and five business days to match an outside offer. The investor's duty can end 90 days after the renter moves out.

Five years of rent checks can buy a renter as little as $5,000 toward the door.

Give Treasury its due. The draft refuses a safe harbor for minority investors who claim only protective rights, narrows who counts as a passive investor and demands written program policies before any purchase. Treasury says the exceptions add supply "without reducing the availability of single-family homes for families." The fine is real too: up to $1 million or three times the purchase price.

Treasury calls this phase one. Reporting and enforcement rules may come later, and HUD still has to write the annual notice large investors must file. The doors get built now.

Burn Notice: A ban is only as strong as the doors it leaves open, and Treasury is taking measurements until Nov. 23.
